These terms govern your use of the lux72 website at lux72.ai (the "site"), which is operated by Gradatim Capital, LLC ("we", "us"). By using the site you agree to these terms. If you do not agree, please do not use the site.

What the site offers

The site publishes research theses, notes on what changed between versions, and interactive financial and industry models (together, the "content"). The content is currently free to read and there are no reader accounts. We may offer paid subscriptions in the future; additional terms will apply to any paid subscription and will be presented at the time of purchase. Consulting engagements are governed by a separate written agreement, not by these terms.

Not investment advice

The content is for informational purposes only. It is not investment advice, an offer, or a solicitation to buy or sell any security, and it should not be your only basis for an investment decision. Our full Disclaimer forms part of these terms. In particular:

  • The views are the author's own and may change without notice.
  • The author may hold positions in the securities or strategies discussed.
  • Reading the site does not create a fiduciary, adviser-client or other professional relationship with you.
  • Content speaks as of its date. We may revise, supersede or withdraw it at any time and have no duty to update it.
  • Models are provided as-is, may contain errors, and depend on assumptions you should test for yourself.

How you may use the content

You may read, download and use the content for your personal use or for internal use within your business. Intellectual property

The site and the content are owned by Gradatim Capital, LLC or its licensors and are protected by copyright and other laws. Apart from the permitted use above, these terms grant you no license or other right in them.

No warranty

The site and the content are provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including as to accuracy, completeness, timeliness, fitness for a particular purpose or non-infringement, and we do not promise that the site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, neither we nor the author will be liable for any loss or damage arising from your use of, or reliance on, the site or the content, including trading or investment losses and any indirect, incidental, special, consequential or punitive damages, even if we were told such damages were possible. Where liability cannot be excluded, it is limited to the greatest extent the law allows.

Indemnity

You agree to indemnify and hold harmless Gradatim Capital, LLC and the author from claims, losses and costs (including reasonable legal fees) arising from your breach of these terms or your misuse of the site or the content.

Links to other sites

The content may link to third-party websites and sources. We do not control them and are not responsible for their content, availability or practices.

Suspension and termination

We may suspend or end your access to all or part of the site at any time, including if we believe you have breached these terms. The sections on investment advice, intellectual property, warranties, liability, indemnity and governing law continue to apply after that.

Changes to these terms

We may update these terms. The effective date at the top of this page shows when they last changed. Continuing to use the site after a change means you accept the updated terms.

Governing law and venue

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising from them or from the site will be brought exclusively in the state or federal courts located in that state, and you consent to their jurisdiction.

General

If any provision of these terms is held unenforceable, the rest remain in effect. These terms, together with the Disclaimer and the Privacy Policy, are the entire agreement between you and us about the site. Our not enforcing a provision is not a waiver of it.
